This Annex 4 forms part of the current Terms of Service.
This Consumer Addendum is an integral part of the Terms of Service between Flower Labs and You. The Consumer Addendum outlines specific rights and obligations if You are a consumer in the meaning of Section 13 of the German Civil Code, supplementing the terms set forth in the Terms of Service. Terms used but not defined in this agreement shall have the same meaning as defined in the Terms of Service.
1. Right of Withdrawal
- You have the right to withdraw from this Agreement within fourteen (14) days without giving any reason.
- The withdrawal period will expire after fourteen (14) days from the day of the conclusion of the Agreement.
- To exercise the right of withdrawal, You must inform us, Flower Labs GmbH, support@flower.ai, of Your decision to withdraw from this Agreement by an unequivocal statement, for example a letter sent by post, fax, or email. You may use the attached model withdrawal form, but it is not obligatory.
- To meet the withdrawal deadline, it is sufficient for You to send Your communication concerning Your exercise of the right of withdrawal before the withdrawal period has expired.
2. Effects of Withdrawal
- If You withdraw from this Agreement, we shall reimburse to You all payments received from You, including the costs of delivery, except for the supplementary costs arising if You chose a type of delivery other than the least expensive type of standard delivery offered by us, without undue delay and in any event not later than fourteen (14) days from the day on which we are informed about Your decision to withdraw from this Agreement.
- We will carry out such reimbursement using the same means of payment as You used for the initial transaction, unless You have expressly agreed otherwise. In any event, You will not incur any fees as a result of such reimbursement.
3. Changes to the Terms of Service
- Any disputes arising out of or in connection with this Agreement shall be subject to the jurisdiction of the courts at Your place of residence. Section 16.3 of the Terms of Service sentence 2 shall not apply.
- With respect to warranties and warranty period, statutory rights shall apply.
4. Additional Provisions
- In the event of any inconsistency between the terms of this Consumer Addendum and the Terms of Service, the terms of this Consumer Addendum shall prevail.
- This Addendum shall be governed by and construed in accordance with the laws of Germany.
- The provisions of this Addendum are in addition to and do not affect Your statutory rights as a consumer under German law.
